Privacy Statement
- Processing of Personal Data. We process personal data (data that directly or indirectly identify natural persons) which we receive from you or involved third parties in the course of or in preparation for the business relationship, or which we collect ourselves. The entity responsible for the data processing described in this privacy policy is AGON Partners (*), Wiesenstrasse 17, 8008 Zurich.
- Source of Data. Some of the personal data are provided by you or the data subjects themselves when you or they contact us via email, social media (e.g., LinkedIn), online contact form, or telephone, and request our services. This includes, for example, name, telephone number, and contact details, as well as information about the role of the data subject at the company or organization for which you or the respective contact persons work or on whose behalf you or they contact us. We also process personal data that we receive in correspondence with third parties (namely clients, opposing parties, authorities, and courts, as well as their employees or other contact persons) in the context of the client relationship (e.g., name, contact details, date of birth, information about employment relationships, income situation, family relationships, or health status). In addition, we collect some personal data ourselves, e.g., from public registers or websites.
- Purpose of Processing. The aforementioned types of personal data are processed by us:
- primarily to provide, document, and invoice our legal services.
- for marketing purposes (using any means of communication such as email, social media, mail, or telephone), to inform about publications, events, news, services, or products that may be of interest (e.g., via a newsletter).
- Disclosure. To achieve the purposes described in this privacy policy, it may be necessary to disclose personal data to the following categories of recipients: external service providers, clients, opposing parties and their legal representatives, business partners with whom we may coordinate the provision of legal services, as well as authorities and courts. In addition, your data may be disclosed to group companies AGON PARTNERS Public Affairs, AGON PARTNERS Compliance, Swiss Legal Tech Solutions GmbH (SLTS), Swiss Association for Compliance and Competition Law (ACCL), Litigation PR, and KMU Foundation.
- Place of Processing. We process personal data mainly in Switzerland and in the EU/EEA within our area of responsibility. However, we may process data worldwide if required by the client relationship. We may transfer personal data to recipients (namely clients, opposing parties, or authorities) who themselves process personal data in other countries, including those that do not provide a level of data protection comparable to Swiss law. In such cases, we rely on consent or standard contractual clauses, or process the data if necessary for contract fulfillment or legal claims enforcement.
- Website. To operate our website securely and stably, we collect technical data such as IP address, information about the operating system and settings of your device, region, time, and type of use. We also use cookies and similar technologies. When using our website (including newsletters and other digital offers), data is collected and stored in logs (especially technical data). We may also use cookies and similar technologies (e.g., pixel tags or fingerprints) to recognize website visitors, analyze their behavior, and identify preferences. A cookie is a small file that is transmitted between the server and your system and allows the recognition of a specific device or browser. You can configure your browser to automatically reject, accept, or delete cookies. You can also disable or delete cookies on a case-by-case basis. However, personal data that we or third-party providers commissioned by us store about you (e.g., if you have a user account with us or these providers) may be linked to the technical data or to the information stored in cookies, and thus possibly to your person. We also use social media plug-ins, which are small software components that establish a connection between your visit to our website and a third-party provider. The social media plug-in informs the third party that you visited our website and may transmit cookies that the third party previously placed on your web browser. 6.5 We use YouTube to embed videos into our website. YouTube is a service of the American Google LLC. 6.6 We use Matomo to analyze the use of our offering. This service also uses cookies. Matomo is a service of analytics.hostkonzept.ch, operated by konzeptplus ag and hosted exclusively in a Swiss data center. We use this service to provide our offering, including our website, effectively, user-friendly, and reliably, especially by analyzing usage including performance and reach measurement for error correction and improvement. As the service is hosted in a Swiss data center, the strict data protection regulations of Switzerland apply. You can object to the statistical collection by Matomo at any time by adjusting the corresponding settings in your browser.
6.7 On our website, we use Adobe Font, a font service from Adobe Systems Incorporated, 345 Park Avenue, San Jose, CA 95110-2704, USA. When Adobe Font is integrated, fonts are loaded from Adobe servers on each visit to our website, which provides Adobe with information that your IP address accessed our website. The use of Adobe Font is in the interest of a uniform and attractive presentation of our online offerings, representing a legitimate interest under Art. 6 (1)(f) GDPR. Adobe has submitted to the EU-U.S. Privacy Shield, ensuring that data protection in the U.S. corresponds to European standards. 6.8 We operate pages and other online presences on social networks and other platforms operated by third parties and process data about you in this context. We receive data from you (e.g., when you communicate with us or comment on our content) and from the platforms (e.g., statistics). The platform providers may analyze your use and process these data together with other data they have about you for their own purposes (e.g., marketing and market research purposes and platform management), acting as independent controllers. If you apply for a position with us, we collect and process the relevant data for the purpose of reviewing the application, conducting the application process, and, in case of successful applications, for preparing and concluding the corresponding contract. In addition to your contact details and information from the communication, we particularly process the data contained in your application documents and data we may obtain about you, e.g., from job-related social networks, the internet, media, and references, if you consent to us obtaining references.
- Data Retention and Data Security. We store personal data only as long as necessary to process the client relationship, if there is a legal retention and documentation obligation, or if we have an overriding private or public interest. We take reasonable and appropriate precautions to protect personal data from loss, unauthorized alteration, or unauthorized access by third parties. If you provide us with personal data through a third party (e.g., your employees or other contact persons), it is your responsibility to inform them generally about the processing by legal service providers (such as us) or other external service providers (e.g., in an employee privacy policy).
- External Services. We point out that in the course of client representation, we use external IT service providers and cloud providers with servers in Switzerland. We also use certain IT services and communication tools that may involve data security risks (e.g., email, video conferencing). It is your responsibility to inform us if you wish for special security measures.
- Processing Interests. We have a legitimate interest in processing personal data for the mentioned purposes. Some processing is also necessary for us to fulfill our contractual obligations towards you or our legal obligations (e.g., retention obligations).
- Attorney-Client Privilege. Attorney-client privilege remains unaffected. For data subject to attorney-client privilege, disclosure to third parties will only occur in consultation with you.
- Your Rights. Data subjects have in particular the right to access their stored personal data and the purpose of its processing, the right to rectification, deletion or restriction of processing, the right to object to processing, the right to lodge a complaint with a competent supervisory authority, and the right to data portability. However, please note that these rights are subject to conditions and exceptions. Where legally permissible or required, we may reject requests to exercise these rights. For example, we may have to retain or further process personal data for legal reasons despite a request for deletion or restriction of processing. If you are located in the EEA, you also have the right to complain to the data protection supervisory authority of your country. - No Consent Required. No consent from clients, their employees, or other contact persons is required for this privacy policy. This privacy policy is solely for information about the nature, scope, and purpose of personal data processing by AGON Partners Legal AG. AGON Partners Legal AG reserves the right to unilaterally change the content of this privacy policy at any time. We will inform you accordingly about any changes.
- GDPR. If the EU General Data Protection Regulation (GDPR) exceptionally applies to certain data processing, then exclusively for the purposes of the GDPR and the processing subject to it, the following applies additionally. We base the processing of your personal data in particular on the following:
- it is necessary for the initiation and execution of contracts and their management and enforcement (Art. 6 para. 1 lit. b GDPR);
- it is necessary for legitimate interests pursued by us or third parties, namely for communication with you or third parties, for operating our website, for improving our electronic offers, for registration for certain offers and services, for security purposes, for compliance with Swiss law and internal regulations for risk management and corporate governance, and for other purposes such as training and education, administration, evidence and quality assurance, organization, execution and follow-up of events, and to protect other legitimate interests (Art. 6 para. 1 lit. f GDPR);
- it is legally required or permitted based on our mandate or position under the law of the EEA or a member state (Art. 6 para. 1 lit. c GDPR);
- you have consented to the processing, e.g., through a corresponding declaration on our website (Art. 6 para. 1 lit. a and Art. 9 para. 2 lit. a GDPR).
